1. Acceptance of Terms

By accessing or using the game_the0ry platform ("Platform"), operated by game_the0ry ("we," "us," or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or use the Platform. By registering, you represent that you meet this requirement.

3. Accounts

Accounts are created via OAuth authentication through Google or Twitch. You are responsible for maintaining the security of your linked account and for all activity that occurs under it. Notify us immediately if you suspect unauthorized access.

4. Creator Accounts & Content

  • Creators retain ownership of the content they upload to the Platform.
  • By uploading content, you grant game_the0ry a non-exclusive, worldwide license to host, display, distribute, and stream your content solely for the purpose of operating the Platform.
  • You represent that you have all necessary rights to the content you upload, that it does not infringe on any third party's intellectual property or other rights, and that it complies with all applicable laws.
  • We reserve the right to remove content that violates these Terms, is reported for infringement, or is otherwise objectionable at our sole discretion.

5. Payments & Revenue Share

  • All payments are processed through Stripe. By using the Platform as a creator or purchaser, you also agree to Stripe's terms of service.
  • Creators receive 80% of each course sale. game_the0ry retains 20% as a platform fee.
  • Payouts are issued according to the payout schedule described in your creator dashboard. We reserve the right to hold or delay payouts in cases of suspected fraud, chargebacks, or Terms violations.
  • All prices are listed in USD unless otherwise stated. Applicable taxes are the responsibility of the buyer or creator as required by law.

6. Student / Purchaser Terms

  • Course purchases grant you a personal, non-transferable license to access the course content for your own educational use.
  • You may not redistribute, resell, screen-record, or publicly share purchased course content.
  • Refunds are handled on a case-by-case basis. Contact us at support if you believe a refund is warranted.

7. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable law.
  • Upload malicious software, spam, or content that is defamatory, obscene, or harmful.
  • Attempt to gain unauthorized access to any part of the Platform, other accounts, or our systems.
  • Scrape, crawl, or use automated tools to extract data from the Platform without permission.
  • Circumvent or interfere with the Platform's payment or access-control mechanisms.
  • Impersonate another person or entity.

8. Intellectual Property

The game_the0ry name, logo, branding, and Platform design are our intellectual property. You may not use our trademarks without prior written consent. All user-generated content remains the property of its respective creators, subject to the license granted in Section 4.

9. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We are not responsible for the accuracy, quality, or legality of creator content. Your use of the Platform is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by law, game_the0ry and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability for any claim shall not exceed the amounts paid by you to game_the0ry in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless game_the0ry from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including Sections 8, 9, 10, and 11) shall survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the Platform or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Delaware.
